Terms of Service

These Terms of Service ("Terms") govern your use of the Tide & Bite mobile application (the "App") provided by Suki App Studio ("we", "us"). By using the App you agree to these Terms. If you do not agree, do not use the App.
1. What the App is
The App is a planning aid for anglers. For a spot you choose, it shows tide predictions, weather, wave and sea-temperature forecasts, sun and moon times, a fishing index with the reasons behind it, a go / no-go safety check, the species in season and a map. It also offers a catch log, reminders for the tide and the best fishing time, a home-screen widget and tools such as a knot guide, a trip checklist, a length-to-weight estimate and links to official fishing rules.
2. Who may use the App
You must be at least 13 years old to use the App. If you are below the age at which you can consent to the processing of your personal data where you live (for example 14 in the Republic of Korea or up to 16 in some European countries), you may use the App only with the consent of a parent or guardian.
3. Free app, advertising and licence
The App is free and has no accounts and no in-app purchases. It is funded by advertising delivered by Google AdMob: one banner at the bottom of the screen. We do not control the content of third-party advertisements and are not responsible for the products or services they promote.
We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, for your own non-commercial use, in accordance with these Terms and the rules of the store you obtained it from. This licence ends when you stop using the App or breach these Terms.
4. An aid, not a guarantee
Tide, weather, wave, sea-temperature, sun and moon information in the App consists of predictions and estimates. It can be wrong, incomplete or late. Tide predictions are calculated from harmonic constants for a nearby station and do not include the effects of wind, air pressure, storm surges, waves or river flow, so actual water levels and times of high and low water can differ, especially far from the station. Forecasts come from third-party models with limited resolution, are refreshed only while the App is open and online, and may be out of date or unavailable. Wave forecasts describe the sea offshore, not the conditions at a particular beach, rock or harbour.
The fishing index, the best times and the go / no-go safety check are automatic assessments of these predictions against general limits. A "go" does not mean that conditions are safe for you, your experience, your boat or kayak, or your spot. The App cannot see dangers such as rogue waves, slippery rocks, strong currents, lightning or a rising tide cutting off your way back.
The App is not for navigation and never replaces official weather and marine warnings, instructions from coast guards, harbour masters and other authorities, local knowledge or your own judgement. Check official sources and the conditions on site before and during every trip, wear a life jacket on rocks and on the water, and do not go out if in doubt. You are responsible for your own safety and for that of the people with you.
5. Fishing rules
You are responsible for knowing and following the fishing laws and rules that apply where you fish, including licences and permits, closed seasons and areas, protected species, minimum sizes and bag limits, gear restrictions and rules on access to land, piers and harbours. The species and season guide, the length-to-weight estimate and other fishing information in the App are general guidance compiled from public sources; they may not match the rules or the fish in your area and are not legal advice. Links to official regulation pages are provided for convenience: the official text prevails, and rules change.
6. Third-party data and services
The App uses data from third parties under their licences:
Weather: MET Norway, licensed under CC BY 4.0 (https://api.met.no/doc/License).
Waves: NOAA WAVEWATCH III, served by PacIOOS at the University of Hawaiʻi.
Sea temperature: NASA JPL MUR and NOAA blended sea-surface temperature, served by NOAA CoastWatch.
Map: OpenFreeMap and OpenMapTiles; map data © OpenStreetMap contributors, available under the Open Database License (https://www.openstreetmap.org/copyright).
Tides: harmonic constants from the Neaps tide database (https://github.com/openwatersio/tide-database), whose sources include TICON-4 and the Norwegian Mapping Authority under CC BY 4.0 (https://creativecommons.org/licenses/by/4.0/), and, for Korea, from the Korea Hydrographic and Oceanographic Agency (KHOA): constants we derived by harmonic analysis of its official tide predictions on the Badanuri ocean information service (https://www.khoa.go.kr/oceangrid/), and its reference-port harmonic constants (https://www.data.go.kr/data/15145395/fileData.do). We have converted these data and, for Korean ports without a tide gauge, filled in the smaller constituents from the nearest gauge.
Place search uses your phone's own geocoding service, and advertising is provided by Google AdMob; your use of those services is subject to their own terms and policies. Full credits are listed in the App under Settings > Data sources. These providers do not endorse the App, give no warranty for their data and may change or stop their services at any time, in which case parts of the App may stop working.
7. Your content
The places, catch entries, notes and photos you add ("your content") remain yours. They are stored only on your device; we do not receive them and claim no rights in them. You are responsible for your content and for what you choose to share, including photos of other people and the location of fishing spots. Keep your own copies: if you uninstall the App or clear its data without a backup, your content is deleted and we cannot restore it. Android's cloud backup does not include catch photos.
8. Acceptable use
You agree not to: use the App for unlawful purposes, including fishing in breach of local rules; interfere with, manipulate or bypass the advertising (for example by clicking advertisements artificially) or any security feature; use the App to send automated or excessive requests to the data services it relies on; remove or hide the credits and notices of third-party data; or copy, modify or reverse engineer the App except where the law permits it.
9. Intellectual property
The App's software, design and original content, including its texts, translations and species and season guide, are owned by us or our licensors. Third-party data and open-source components are provided under their own licences. Nothing in these Terms transfers ownership of them to you.
10. Disclaimer
The App is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows, including warranties of accuracy, availability, fitness for a particular purpose and non-infringement. We do not warrant that the App or its data will be accurate, complete, timely, uninterrupted or error-free, or that reminders will arrive on time; the phone's power saving can delay them.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for any loss, injury or damage arising from your reliance on a prediction, forecast, index, safety check, time, rule or other information in the App, or from the App or third-party data being unavailable. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for intent or gross negligence, for death or personal injury caused by negligence, or your statutory rights as a consumer. If you are a consumer in the European Union, the United Kingdom, the Republic of Korea or another country with mandatory consumer protection, those protections continue to apply, and any provision of these Terms that conflicts with them applies only to the extent they allow.
12. Changes and termination
We may update the App, add or remove features, or change these Terms. Material changes to these Terms will be announced inside the App or on its store page before they take effect; if you continue to use the App after that, the updated Terms apply. We may suspend or discontinue the App at any time. You may stop using the App at any time by uninstalling it. If any provision of these Terms is held invalid, the remaining provisions stay in effect.
13. Governing law
These Terms are governed by the law of the Republic of Korea. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring proceedings before the courts of that country.
