Terms of Service

These Terms of Service ("Terms") govern your use of the Pick Party mobile application (the "App") provided by Suki App Studio ("we", "us"). By using the App you agree to these Terms. If you do not agree, do not use the App.
1. What the App is
The App helps groups make random choices in a fun way: picking one or several people, splitting people into teams, putting them in order, handing out results such as prizes or chores, or picking an option such as a lunch menu, through games such as a prize wheel, a ladder lottery, a marble race, a lane race, card flips, a name reel, a capsule toy machine and a spotlight. It also offers pass-the-phone party games (finger pick, reaction duel, stop at 10, hot potato, pirate barrel, spin the bottle and number bomb), a Secret Santa draw, a penalty card draw and quick tools (coin flip, dice and random numbers), and keeps your lists, groups and past results on your device.
2. Who may use the App
You must be at least 13 years old to use the App. If you are below the age at which you can consent to the processing of your personal data where you live (for example 14 in the Republic of Korea or up to 16 in some European countries), you may use the App only with the consent of a parent or guardian.
3. Free app, advertising and licence
The App is free and has no accounts and no in-app purchases. It is funded by advertising delivered by Google AdMob: a banner at the bottom of the menu screens, and now and then a full-screen ad when you leave a result for the home screen or another game. No advertisement is shown during a game or on a result. You may choose to watch a short video ad to use the App without ads for two hours ("Party mode"); this is optional and nothing in the App requires it. We do not control the content of third-party advertisements and are not responsible for the products or services they promote.
We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, for your own non-commercial use, in accordance with these Terms and the rules of the store you obtained it from. This licence ends when you stop using the App or breach these Terms.
4. Random results are for fun
Each game's result is decided on your device by the Android system's secure random number generator. In every game of chance each person, team place or order position has the same chance; the animations only show the result. When you turn on "Balance by skill", teams are formed to even out the stars you gave, and only the rest is left to chance. Reaction duel and Stop at 10 are games of skill: their result depends on the players. We nevertheless give no guarantee that any result is fair for a particular purpose, and the App is not certified, audited or suitable for official lotteries, prize promotions, raffles that require an independent draw, legal or employment decisions, or any decision with serious consequences for anyone.
Do not use the App for gambling or for betting money or anything of value, or for any activity that is illegal where you are. You are responsible for how you and your group use a result. Agree on the rules before you play and accept that a random result can feel unfair to someone.
5. Play safely and kindly
Pass-the-phone games involve handing the phone to other people. Hold it firmly, do not throw it, and keep the game away from water and traffic. The penalty cards in the App are light suggestions, and anyone may say no to one. Take care with the penalties, dares or drinks your group attaches to a result: never pressure anyone into something unsafe, illegal, humiliating or against their will, do not drink and drive, and respect people who do not want to take part. The App's sound and vibration effects can be turned off in Settings.
6. Your content
The names, lists, groups, topics, penalty cards and results you enter ("your content") remain yours. They are stored only on your device; we do not receive them and claim no rights in them. You are responsible for your content and for what you choose to share, including the names of other people. Use only names and nicknames that the people concerned are happy for you to use, and do not enter offensive or sensitive information. If you uninstall the App or clear its data without a backup, your content is deleted and we cannot restore it.
7. Acceptable use
You agree not to: use the App for unlawful purposes, gambling, harassment or bullying; interfere with, manipulate or bypass the advertising (for example by clicking advertisements artificially) or any security feature; or copy, modify or reverse engineer the App except where the law permits it.
8. Intellectual property
The App's software, games, graphics, sounds and texts, including translations, are owned by us or our licensors. Open-source components are provided under their own licences. Nothing in these Terms transfers ownership of them to you.
9. Disclaimer
The App is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows, including warranties of accuracy, availability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for any loss, injury or damage arising from a result produced by the App, from the way you or your group use a result, from the games played with it, or from the App being unavailable. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for intent or gross negligence, for death or personal injury caused by negligence, or your statutory rights as a consumer. If you are a consumer in the European Union, the United Kingdom, the Republic of Korea or another country with mandatory consumer protection, those protections continue to apply, and any provision of these Terms that conflicts with them applies only to the extent they allow.
11. Changes and termination
We may update the App, add or remove features, or change these Terms. Material changes to these Terms will be announced inside the App or on its store page before they take effect; if you continue to use the App after that, the updated Terms apply. We may suspend or discontinue the App at any time. You may stop using the App at any time by uninstalling it. If any provision of these Terms is held invalid, the remaining provisions stay in effect.
12. Governing law
These Terms are governed by the law of the Republic of Korea. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring proceedings before the courts of that country.
