Terms of Service

These Terms of Service ("Terms") govern your use of the Wish Hertz mobile application (the "App") provided by Suki App Studio ("we", "us"). By ticking the consent boxes and using the App you agree to these Terms. If you do not agree, do not use the App.
1. What the App is
The App is a work of entertainment and relaxation. It generates ambient sounds ("frequencies") on your device: built-in ones named after common wishes, and custom ones generated from text that you type.
The App does not make wishes come true. The names and descriptions of the frequencies express a theme or a mood. They are not statements of fact. The sounds are not scientifically proven to affect height, skin, hair, weight, sleep, health, relationships, luck, money, admission, employment or any other outcome. Nothing in the App is a promise, a prediction or a guarantee of any result.
2. Not medical or professional advice
The App is not a medical device and does not diagnose, treat, cure or prevent any condition. It does not replace a doctor, a therapist, a financial adviser or any other professional. Do not delay or stop professional care because of the App. If you have epilepsy, a seizure disorder, a heart condition, a hearing condition or are pregnant, ask a doctor before listening to pulsing or binaural sounds.
Listen at a comfortable volume; long listening at high volume can damage hearing. Do not listen while driving, operating machinery or doing anything that needs your full attention. Stop listening if you feel discomfort, dizziness or a headache.
3. Who may use the App
You must be at least 14 years old to use the App. If the law of your country sets a higher age for agreeing to these Terms or to the processing of your data (for example 16 in some European countries), you must have reached that age or have the consent of your parent or guardian.
4. Advertising
The App is free and funded by advertising delivered by Google AdMob. Banner advertisements are shown at the bottom of the home screen and of each frequency's screen. Listening to frequencies does not require watching an advertisement. A rewarded advertisement is shown each time you create a frequency; the creation continues after the advertisement has been played to the end, and if you close it early, the creation is cancelled. If no advertisement is available, the App may continue without one. We do not control the content of third-party advertisements and are not responsible for the products or services they promote.
5. Your frequencies
The text you type to create a frequency and the list of frequencies you created are stored only on your device. They are not sent to us. Do not type sensitive personal information about yourself or other people. Uninstalling the App or clearing its data deletes them, and we cannot restore them.
6. Background playback
A frequency keeps playing, including in the background and with the screen off, until you stop it or the sleep timer ends. Playback uses battery. You can stop it at any time in the App or from the notification.
7. Acceptable use
You agree not to: use the App for unlawful purposes; interfere with or bypass the advertising or any security feature; reverse engineer the App except where the law permits it; or present the App's sounds to others as a medical treatment or a guaranteed method.
8. Intellectual property
The App's software, sounds and original content are owned by us or our licensors and are licensed to you for personal, non-commercial use only. This licence ends when you stop using the App or breach these Terms.
9. Disclaimer
The App is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. We do not warrant that the App will be uninterrupted or error-free, or that it will produce any effect. Any decision you take in connection with the App is yours alone.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for any loss arising from your reliance on the App. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for intent or gross negligence, or your statutory rights as a consumer.
11. Changes and termination
We may update the App or these Terms. Material changes will be announced inside the App or on its store page before they take effect. We may suspend or discontinue the App at any time. You may stop using the App at any time by uninstalling it.
12. Governing law
These Terms are governed by the law of the Republic of Korea. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring proceedings before the courts of that country.
